You may be right about the legal firm.

I did get the impression that they did not want to challenge the National Park Authority.

I choose them because they had been involved in the legal challenges at Bagby but that is a different planning authority.

However a fifth application with a different planning consultant and ecologist would cost less if it was successful.

Just need to find the right planning consultant.

Peter Kember ran a planning consultancy helping cases such as yours, some years ago. If I recall correctly he was on the National committee of the LAA to a time. Not sure if he is still practicing but probably worth trying to make contact for advice or useful contacts he may impart.

It is self-evident that birds are happy to colonise airfields. (plenty of posters have already pointed out that they actually can become a menace and cost a lot of time, energy and money to dissuade.

Is there any mileage in suggesting that the planning-officer who put forward this specious and unfounded argument, is either incompetent or carrying a hidden agenda which clouds his objectivity.?
Do you get to keep your 28 day ops, irrespective?

I wonder if there is anything to prevent you, meanwhile, registering the site with the CAA for the AIP ? I suppose it might attract unwelcome overflying ..

You definitely need a planning consultant like Peter Kember but it'll no doubt cost you as will a decent lawyer (a high street lawyer simply will not do for this sort of thing as you need a specialist planning lawyer).

30/03/2018 Update - Kember, Loudan Williams will submit 5th. planning application once the Ecological Impact Assessment has been completed.
Had two ecologists for two days this week. Five more visits planned over next six months.

What I fail to understand is why the planners think a single engine aircraft has more environmental impact than farming equipment. You could after all buy the biggest, noisest most poluting tractor or digger, then run it 24/7 and the planners couldn't do anything about it. Does the prohibition order ban aircraft from the property or just from taking off and landing?

Browsing through this thread no one seems to have mentioned any comparison to Lundy Island, EGZV. Small publicly available airstrip there, in the middle of an SSSI & nature reserve. Internationally important populations of birds, wildlife, fauna & flora. Conservation of all of these in the hands of the Landmark Trust working with the RSPB. The strip run by the Landmark Trust. Far more sensitive I would have thought than South Moor. The Landmark Trust obviously have no issues with an airstrip there as they could close it anytime.
