But does the AIP trump EU legislation? I don't think so. What it does is provide a justification for unwittingly breaking the law. (I am referring to the 10 aerodromes stripped of Customs. The Cherbourg case is different, because there has been no official notice that conflicts with the AIP).

But if the official means of promulgation (In this case, AIP + NOTAMs) is not up to correct or up to date, the problem lies with the relevant arm of the State, not the citizen.

Sure, the State's representatives could choose to sanction the uninformed, but will they?

An honest and justifiable well-intentioned innocent fault would expose bureaucratic stupidity

Bureaucrats hate that.

There appears to be some fault here if official reference info does not (yet) match the underlying legislation. Those persons at fault are not the pilots who plan correctly.

The legal promulgation mechanism is the AIP / VAC.

As long as you have read and abide by the currently published AIP Data, then I can't see how you can be prosecuted for something that has not been legally promulgated.

The plot thickens. LFSM lost its Customs status in the latest cull. It now requires PN to Customs for intra-Schengen flights. A ploy to continue serving Swiss traffic?
